Just after the court's order, Dixit handed over the charge of RCA to vice president Shivcharan Mali.
The order was passed on a petition under Section 9 of the Arbitration and Conciliation Act, 1996 for grant of interim relief after an alleged dispute has crept up in the RCA which to be settled by reference to an Arbitrator as per the Sports Act of the state.
Under Section 9, an ad-interim relief can be claimed for any dispute in a sports federation or association in the state even prior to the reference of any dispute to an arbitrator.
According to the petition filed by Rajendra Singh Rathore and his group, they claimed to be representatives of the Dixit-led RCA which was elected on February 22 this year, uprooting IPL chief Modi.
The elections was held under the directions of the Supreme Court and in the supervision of former judge N M Kasliwal.
In the petition it was alleged that after his election to the office, Dixit started to gain power by making futile by-laws and also allowed some new district members to become part of the RCA in order to gain majority and due to his illegal actions the association has suffered losses.
The petition alleged that Dixit illegally removed former secretary Ashok Ohri form the post and continued in the office despite a majority of the 18 district cricket associations, which were member of the governing body of the RCA, has brought in no confidence motion against him.
An executive committee was also formed with Rathore as chairman of the Committee and Giriraj Sanadya as acting secretary on September 21.
It was also mentioned in the petition that Rathore has made a reference for arbitration of the dispute.
After looking at the facts, the Additional District and Sessions Judge Court granted ad-interim restraint order, asking Dixit not to interfere in the matters of RCA till the matter is referred to an arbitrator.
