Modi refutes Subhash Joshi's claims of second constitution

Rajasthan Cricket Association (RCA) President Lalit Modi on Sunday refuted the claims of Secretary Subhash Joshi that another constitution of the association other than the current one is in existence.

Modi said that the RCA has an approved constitution and the question of another one being adopted at the behest of Joshi does not arise.

"One constitution was filed by ad-hoc body on January 28 2005 and another on February 2, 2005. We had received the certified copy of the second one on April 27, 2005 and so the approval from executive committee was not required. We have been using copies of same constitution everywhere," Modi said.

He also said that if the Registrar has approved any new constitution then its copies have not yet been circulated.

"I read in newspapers there is a new constitution but I still have not received its copy. The legalities specified in the Sports Ordinance have not been followed," said Modi.

"We will certainly ask the Registrar to clarify the position. Even the persons who have signed the so called constitution might not be the authorised signatories for the respective district units."

On the case of alleged misappropriation of Rs 22 lakhs regarding which he was summoned to a police station yesterday, Modi said that the BCCI has made the things clear.

"It was not legally binding because I was not provided the copies of complaint or FIR. Still I co-operated the police and went along with them," he said.

Asked if elections would be held on February 22, Modi said Joshi did not have powers to announce election dates. "I had already divested him of his powers as secretary and the so called meeting which I would like to call only a social meeting was not legal so how could the elections announced by Joshi could take place," Modi said.
